Links & Co is an online retail and e-commerce reseller. Products displayed on our website are sold directly by Links & Co and may be sourced from suppliers, manufacturers, wholesalers, distributors or other approved product providers.

By accessing or using our website, creating an account, placing an order or purchasing a product, you agree to be bound by these Terms, together with the other policies applicable to your transaction.

If you do not agree with these Terms, you should not use the website or place an order.

3. SOUTH AFRICAN LAW

Links & Co operates its online retail business in accordance with applicable South African legislation.

Depending on the transaction and circumstances, this may include:

  • Consumer Protection Act 68 of 2008 ("CPA");

  • Electronic Communications and Transactions Act 25 of 2002 ("ECTA");

  • Protection of Personal Information Act 4 of 2013 ("POPIA");

  • applicable tax and VAT legislation;

  • applicable intellectual-property legislation; and

  • other legislation applicable to the products or transactions.

Nothing in these Terms is intended to unlawfully exclude, restrict or waive any consumer right that cannot legally be excluded, restricted or waived.


4. ELIGIBILITY TO PURCHASE

By placing an order through our website, you confirm that:

  • the information you provide is accurate and complete;

  • you are legally capable of entering into a binding transaction;

  • you are authorised to use the payment method provided;

  • the delivery information supplied by you is accurate; and

  • you will comply with these Terms and applicable law.

Where a person is legally unable to enter into a transaction independently, the transaction must be completed with the involvement of an appropriate parent, guardian or legally authorised person where required by law.


5. OUR E-COMMERCE BUSINESS MODEL

Links & Co operates as an online retailer and reseller.

This means:

  1. You purchase products directly from Links & Co through our website.

  2. Links & Co receives and processes your order and payment.

  3. Links & Co may source products from third-party suppliers or approved product providers.

  4. A supplier, manufacturer, warehouse, fulfilment partner or logistics provider may assist Links & Co with sourcing, packaging, processing or dispatching an order.

  5. Delivery may be completed by an independent courier or logistics provider.

  6. Your contractual purchase relationship remains with Links & Co, subject to applicable law and the terms of your transaction.

The involvement of a supplier or fulfilment provider does not transfer Links & Co's obligations to the customer where those obligations arise under applicable law.


6. PRODUCTS AND PRODUCT INFORMATION

We endeavour to ensure that product descriptions and information displayed on our website are accurate and sufficiently detailed to assist customers in making informed purchasing decisions.

  • photographs;

  • description;

  • features;

  • specifications;

  • dimensions;

  • quantity;

  • availability;

7. PRODUCT AVAILABILITY

Products displayed on our website are subject to availability.

An item appearing on the website does not necessarily mean that it is immediately available for dispatch.

Links & Co may need to confirm stock availability with a supplier or fulfilment provider after an order is placed.

If a product becomes unavailable after an order has been placed, Links & Co will take reasonable steps to notify the customer and provide an appropriate remedy in accordance with applicable law and our Refund, Returns & Cancellation Policy.


8. PRICES

All prices are displayed in South African Rand (ZAR) unless otherwise stated.

The price applicable to an order will be the price displayed at the time the customer completes the transaction, subject to applicable law.

Delivery charges and other applicable mandatory costs will be disclosed before completion of the transaction.

Where Links & Co is VAT registered and VAT applies, VAT will be handled in accordance with applicable tax legislation.

Where Links & Co is not VAT registered, Links & Co will not represent itself as a VAT-registered supplier or charge VAT as such.

Links & Co reserves the right to correct genuine pricing or information errors. Where an error materially affects an order, Links & Co will take reasonable steps to address the affected transaction in accordance with applicable law.


9. PROMOTIONS AND DISCOUNTS

From time to time, Links & Co may offer:

  • promotional prices;

  • discounts;

  • limited-time offers;

  • coupon codes;

  • promotional bundles;

  • free-delivery promotions; or

  • other special offers.

Promotions may be subject to additional terms, including:

  • promotional periods;

  • product availability;

  • minimum order values;

  • quantity limitations;

  • customer eligibility; or

  • other stated conditions.

Promotional terms displayed at the time of the offer will apply to the relevant promotion.

Unless expressly stated otherwise, promotions may not be combined.


10. PLACING AN ORDER

Where an order cannot be fulfilled, Links & Co will notify the customer and, where payment has already been received, process the applicable refund or other remedy in accordance with applicable law.

Payment may be processed through third-party payment providers or payment gateways.

Links & Co does not ordinarily retain complete bank-card information where payment is processed through an external payment provider.

Orders may be subject to payment verification and reasonable fraud-prevention procedures.

A transaction will only proceed once the applicable payment has been successfully authorised or confirmed.


13. ELECTRONIC TRANSACTIONS

Links & Co uses electronic systems to process online transactions.

Where applicable, customers will have an opportunity to:

  • review delivery charges;

  • review customer information;

  • identify and correct errors; and

  • confirm the transaction before final submission.

14. ORDER CONFIRMATION

Following successful processing, Links & Co may send an order confirmation to the email address or other contact details provided by the customer.

  • delivery information;

  • payment information; and

  • estimated delivery timeframe.

Customers should contact Links & Co promptly if any information contained in an order confirmation is incorrect.


15. DELIVERY

Links & Co currently offers delivery within South Africa, subject to product availability and courier coverage.

Estimated Delivery Period

Up to 15 business days

The estimated delivery period begins following successful payment confirmation and order processing.

The delivery period may include:

  • order processing;

  • stock confirmation;

  • supplier fulfilment;

  • packaging;

  • dispatch;

  • courier collection;

  • transportation; and

  • final delivery.

The 15-business-day period is an estimated timeframe and is not an unconditional guarantee of delivery on a specific date, unless a specific delivery date has expressly been agreed.

Delivery may be affected by:

  • courier delays;

  • public holidays;

  • incorrect delivery information;

  • remote delivery locations;

  • high order volumes;

  • adverse weather;

  • operational disruptions; or

  • circumstances outside Links & Co's reasonable control.

16. DELIVERY ADDRESS

Customers are responsible for providing accurate delivery information.

Links & Co is not responsible for delivery problems caused by incorrect, incomplete or outdated information supplied by the customer.

Customers should ensure that:

  • the address is complete;

  • the correct postal code is provided;

  • the recipient's name is accurate;

  • contact information is correct; and

  • someone is reasonably available to receive the delivery where required.

Additional delivery charges may apply where a parcel needs to be re-delivered because of incorrect information supplied by the customer, subject to applicable law.


17. THIRD-PARTY FULFILMENT AND SUPPLIERS

Links & Co may use suppliers, manufacturers, wholesalers, warehouses or fulfilment partners to assist with fulfilling customer orders.

These third parties may assist with:

  • sourcing products;

  • stock handling;

  • packaging;

  • order preparation;

  • dispatch; or

  • logistics.

The use of third-party fulfilment does not create a separate purchase contract between the customer and the supplier unless expressly stated.

Customers should direct order-related queries, complaints, returns and refund requests to Links & Co unless we specifically instruct otherwise.


18. IMPORTED OR INTERNATIONALLY SOURCED PRODUCTS

Some products sold by Links & Co may be sourced from suppliers or manufacturers outside South Africa.

Where applicable, Links & Co will take reasonable steps to ensure that products offered for sale comply with applicable South African requirements.

International sourcing may affect:

  • stock availability;

  • fulfilment time;

  • delivery time;

  • product packaging;

  • product specifications; or

  • product availability.

Any applicable import-related costs or charges that are required to be disclosed to the customer will be communicated in accordance with applicable law.


19. RETURNS, REFUNDS AND CANCELLATIONS

Customers may have rights to cancel orders, return products or obtain refunds under South African law and Links & Co's Refund, Returns & Cancellation Policy.

These may include rights relating to:

  • electronic transaction cooling-off periods;

  • defective goods;

  • damaged goods;

  • incorrect products;

  • unsuitable products where applicable;

  • change-of-mind returns where legally applicable;

  • cancellations before dispatch;

  • replacements; and

Nothing in these Terms limits a statutory consumer right.


20. ELECTRONIC TRANSACTION COOLING-OFF RIGHTS

If a product is defective, damaged, unsafe or otherwise does not comply with applicable consumer-protection requirements, customers should contact Links & Co as soon as reasonably possible.

Depending on the circumstances and applicable law, remedies may include:

Customers should not return products to suppliers directly unless Links & Co provides specific instructions to do so.


22. INCORRECT PRODUCTS

If you receive a product that is materially different from the product ordered, please contact Links & Co.

Where appropriate, we may request:

  • photographs;

  • order information;

  • product information;

  • packaging information; or

  • other reasonable evidence.

Where the incorrect supply is attributable to Links & Co or its fulfilment arrangements, the appropriate remedy will be handled in accordance with applicable law.


23. STATUTORY WARRANTY

Nothing in these Terms limits applicable statutory warranties.

Where the CPA applies, consumers may have statutory rights relating to the quality, safety and suitability of goods, including applicable implied warranty rights.

Where a product is subject to a manufacturer's or supplier's additional warranty, the terms of that warranty may also apply.

A manufacturer's warranty does not automatically replace or remove a consumer's statutory rights.


24. CUSTOMER ACCOUNTS

Where the website allows customers to create accounts, customers are responsible for maintaining the confidentiality of their login credentials.

Customers should:

  • use secure passwords;

  • keep login information confidential;

  • notify Links & Co of suspected unauthorised access; and

  • ensure that account information remains accurate.

Where a specific product, promotion or transaction contains additional terms, those terms will apply to the relevant transaction to the extent that they are lawful and do not unlawfully restrict consumer rights.


44. CONSUMER RIGHTS PRESERVED

Nothing in these Terms is intended to:

  • waive a statutory consumer right;

  • exclude a mandatory legal obligation;

  • remove a remedy available under the CPA or other applicable legislation; or

  • prevent a customer from exercising a right that cannot lawfully be excluded.

If any provision of these Terms conflicts with a mandatory provision of South African law, the mandatory legal provision will prevail.
