1. INTRODUCTION
These Terms of Service ("Terms", "Terms of Service" or "Agreement") govern your access to and use of the Links & Co website and your purchase of products through our online store.
By accessing our website, creating an account, placing an order or purchasing products from Links & Co, you acknowledge that you have read, understood and agree to be bound by these Terms and the other policies referred to in them.
Links & Co (Pty) Ltd operates as a South African online retailer and e-commerce reseller. Products displayed on our website are sold directly to customers by Links & Co.

3. ACCEPTANCE OF THESE TERMS
By using the Links & Co website or placing an order, you agree to be bound by these Terms.
If you do not agree with these Terms, you should not use the website or place an order.
If you purchase products on behalf of a company, organisation or another person, you confirm that you have the authority to enter into the transaction on their behalf.

7. PRICES

8. VAT
Where Links & Co is registered for VAT and VAT is applicable to a transaction, pricing and invoices will be handled in accordance with applicable South African VAT legislation.
Where Links & Co is not VAT registered, Links & Co will not represent itself as VAT registered or charge VAT as a VAT-registered supplier.
9. ORDERS
When you place an order through the Links & Co website, you submit a request to purchase the selected products.
After receiving your order, Links & Co may send an electronic order confirmation.
An order may be subject to:

Links & Co will not require customers to waive statutory rights merely because a third party is involved in fulfilling an order.

Returns, refunds, replacements and cancellations are governed by the Links & Co Refund, Returns & Cancellation Policy.

Nothing in these Terms or the Refund, Returns & Cancellation Policy removes any statutory consumer right.
Customers may have statutory rights under the CPA and ECTA, including applicable cooling-off rights, remedies relating to defective goods and other consumer protections.
18. STATUTORY WARRANTY AND QUALITY OF GOODS
Links & Co recognises customers' statutory rights relating to the quality, safety, durability and suitability of goods.
Where applicable, the CPA provides consumers with statutory remedies concerning defective or unsuitable goods, including the statutory implied warranty of quality.
Nothing in these Terms is intended to exclude, reduce or waive those statutory rights.
Where a manufacturer or supplier provides an additional warranty, that warranty may apply in addition to statutory consumer rights.
19. DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS
Customers should contact Links & Co if they receive:

Where a statutory remedy applies, Links & Co will address the matter in accordance with applicable South African law.
Customers should retain the original packaging where reasonably possible until the matter has been resolved.
20. MANUFACTURER WARRANTIES
Certain products may be supplied with a manufacturer's or supplier's warranty.
Where a separate manufacturer's warranty applies, the applicable warranty terms may also apply.
A manufacturer's warranty does not remove statutory consumer rights that apply under South African law.

Links & Co may experience circumstances beyond its reasonable control, including:

Nothing in this section removes or limits any statutory consumer right.
32. FRAUD AND SECURITY
Links & Co may investigate transactions that appear suspicious, fraudulent or unlawful.
Where reasonably necessary, an order may be delayed, declined or cancelled to protect:

Where payment has already been made and a refund is legally required, the refund will be processed in accordance with applicable law and the Links & Co Refund, Returns & Cancellation Policy.

Where a mandatory statutory consumer right conflicts with a provision of these Terms, the statutory right will prevail.

Links & Co currently operates as an online retailer and e-commerce reseller.
Under the current business model:

Customers place orders directly with Links & Co.

Customers make payment to Links & Co through the available payment method.

Links & Co processes and confirms the order.

Where applicable, Links & Co obtains or instructs a supplier or fulfilment partner to fulfil the order.

The product is prepared and dispatched through the applicable fulfilment arrangement.

Links & Co coordinates the customer's order and delivery process.
Links & Co does not currently operate a multi-vendor marketplace under these Terms, and independent third-party merchants do not independently sell products directly to customers through the Links & Co website under the current business model.
If Links & Co materially changes its business model in the future, including introducing a multi-vendor marketplace, merchant accounts, seller commissions or digital wallet functionality, the applicable legal terms and policies may be reviewed and updated before such services are introduced.
