SHIPPING & DELIVERY POLICY

1. INTRODUCTION
Links & Co (Pty) Ltd ("Links & Co", "we", "us" or "our") operates as a South African online retailer and e-commerce reseller, supplying products to customers within South Africa.
Products purchased through the Links & Co website are sold directly by Links & Co. We may source products from established suppliers, manufacturers, wholesalers, distributors and other approved third-party product providers.
Certain products may be fulfilled through suppliers, warehouses, logistics providers or courier companies on behalf of Links & Co.
This Shipping & Delivery Policy explains how orders are processed, prepared, dispatched and delivered.
Our objective is to provide customers with a convenient, reliable and transparent delivery experience.
This policy is intended to operate in accordance with applicable South African legislation, including the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").
Nothing in this policy is intended to limit, exclude or waive any consumer right that cannot lawfully be limited, excluded or waived.
2. ESTIMATED DELIVERY TIMEFRAME
Estimated Delivery: Up to 15 Business Days
Links & Co aims to deliver orders within an estimated period of up to 15 business days from confirmation of payment and successful processing of the order.
The estimated delivery period may include:

order processing;

stock confirmation;
-
supplier fulfilment;
-
packaging;
-
dispatch;
-
courier collection;
-
transportation; and
-
final delivery.
The 15-business-day period is an estimated delivery timeframe and not an unconditional guarantee of delivery on a specific date, unless a specific delivery date has expressly been agreed with the customer.
Certain products, locations or circumstances may require additional time. Where Links & Co becomes aware of a material delay, we will make reasonable efforts to notify the affected customer.
3. ORDER PROCESSING
Once payment has been successfully received, Links & Co will begin processing the order.
Customers will generally receive an electronic order confirmation containing relevant order information.
Orders may require additional processing time where:

stock needs to be confirmed;

a product needs to be sourced from a supplier;
-
additional payment verification is required;
-
the delivery address requires clarification;
-
fraud-prevention checks are required;
-
a product requires special handling; or
-
other circumstances reasonably affect fulfilment.
The estimated delivery period may therefore depend on successful order processing, product availability and fulfilment arrangements.
4. SUPPLIER AND THIRD-PARTY FULFILMENT
Links & Co may use suppliers, manufacturers, distributors, warehouses and other approved fulfilment partners to assist with customer orders.
Depending on the product, a third-party fulfilment partner may be responsible for:

packaging;

dispatching the product;

arranging courier collection; or

providing fulfilment information to Links & Co.
Where a supplier or fulfilment partner is involved, Links & Co remains the customer's point of contact for the purchase made through our website.
The involvement of a supplier or fulfilment partner does not remove or reduce Links & Co's obligations to customers under applicable South African law.
5. DISPATCH
Orders will be dispatched once the relevant product or products have been prepared for delivery.
Where tracking is available, customers may receive tracking information once the order has been handed to the applicable courier or delivery provider.
The time between order confirmation and dispatch may vary depending on:

product availability;

supplier processing;
-
warehouse availability;
-
order volumes;
-
public holidays;
-
fulfilment requirements; and
-
other operational circumstances.
Links & Co will endeavour to dispatch orders as soon as reasonably possible.
6. COURIER AND DELIVERY PROVIDERS
Orders may be delivered using third-party courier, logistics or delivery providers.
Once an order has been handed to a courier or logistics provider, the delivery will be subject to that provider's transportation network, operating procedures and delivery processes.
Where tracking is available, Links & Co may provide the customer with the relevant tracking information.
Customers should ensure that the delivery address and contact details supplied during checkout are accurate and complete.
7. DELIVERY AREAS
Links & Co currently offers delivery within South Africa, subject to product availability and courier coverage.
Certain remote, rural or outlying areas may require:

additional delivery time;

additional delivery charges; or

alternative delivery arrangements.
If a particular address cannot be serviced by the applicable courier or delivery provider, Links & Co will contact the customer to discuss the available options.
8. DELIVERY FEES
Applicable delivery charges will be displayed during checkout or otherwise communicated to the customer before the order is completed.
Delivery fees may vary depending on factors such as:

courier service;

fulfilment arrangement; and

9. MULTIPLE PRODUCTS IN ONE ORDER
Where an order contains multiple products, the products may be dispatched together or separately.
Customers may therefore receive more than one parcel or delivery for a single order.
Products may arrive at different times depending on:

10. DELIVERY ADDRESS
Customers are responsible for providing a complete and accurate delivery address.
Please ensure that the following information is correct:

physical delivery address;

suburb;

city or town;
-
province;
-
postal code;
-
contact number; and
-
any relevant delivery instructions.
Links & Co may not be responsible for delays or failed delivery caused solely by incorrect or incomplete information supplied by the customer, subject to applicable consumer rights.
Where reasonably possible, Links & Co will attempt to contact the customer if clarification is required.
Additional delivery charges may apply where a courier must make a further delivery attempt due to incorrect or incomplete information supplied by the customer, where permitted by law.
11. FAILED DELIVERY ATTEMPTS
A courier or delivery provider may be unable to complete delivery where:

nobody is available to receive the order;
-
the delivery address is incorrect or incomplete;
-
the customer cannot be contacted;
-
access to the delivery location is unavailable;
-
the customer refuses or is unable to accept delivery; or
-
another circumstance outside the courier's reasonable control prevents delivery.
The courier may arrange a further delivery attempt or contact the customer for further instructions.
Where additional delivery costs arise due to circumstances attributable to the customer, the customer may be responsible for those additional costs where permitted by law.
Nothing in this section limits a customer's statutory rights.
12. INSPECTION ON DELIVERY
Customers are encouraged to inspect their package upon delivery.
If the outer packaging appears visibly damaged, customers should, where reasonably possible:

photograph the packaging;
-
photograph the product;
-
record the visible damage; and
-
contact Links & Co as soon as reasonably possible.
Customers should retain damaged packaging where it may be relevant to an investigation.
Failure to report visible damage immediately does not automatically remove any statutory rights the customer may have under South African law.
13. PRODUCTS DAMAGED DURING DELIVERY
If a product arrives damaged, customers should contact Links & Co as soon as reasonably possible.
Please provide:

order number;
-
product name;
-
photographs of the product;
-
photographs of the packaging; and
-
a description of the damage.
Links & Co may request additional information where reasonably necessary to investigate the matter.
Where the damage gives rise to a statutory consumer remedy, Links & Co will arrange the appropriate remedy in accordance with applicable South African law.
Where necessary, Links & Co may liaise with the relevant supplier, fulfilment partner or courier to investigate and resolve the matter.
14. DELAYED DELIVERY
Although Links & Co aims to deliver orders within the estimated 15-business-day period, delays may occasionally occur.
Potential causes include:

courier delays;
-
severe weather;
-
public holidays;
-
strikes or industrial action;
-
supply-chain disruptions;
-
product availability;
-
supplier fulfilment delays;
-
incorrect delivery information;
-
customs or import processes where applicable;
-
unusually high order volumes;
-
technical or operational problems; or
-
circumstances outside Links & Co's reasonable control.
Where Links & Co becomes aware of a significant delay, we will make reasonable efforts to notify the affected customer and provide an updated delivery estimate where available.
15. ORDERS NOT DELIVERED WITHIN THE AGREED PERIOD
Links & Co will communicate the applicable delivery timeframe to customers before or during the online purchasing process.
Where a specific delivery period has been agreed with the customer, Links & Co will endeavour to meet that period.
Where an order is not delivered within an agreed period, customers may have rights and remedies under applicable South African law, including rights that may arise under ECTA.
Where goods cannot be supplied because they are unavailable, Links & Co will notify the customer and process any applicable refund in accordance with applicable law and our Refund, Returns & Cancellation Policy.
16. UNAVAILABLE PRODUCTS
If a product becomes unavailable after an order has been placed, Links & Co will notify the customer as soon as reasonably practicable.
Depending on the circumstances, Links & Co may offer:

an alternative product;
-
a revised delivery arrangement; or
-
cancellation and a refund where required or appropriate.
Where the order cannot be fulfilled, Links & Co will process any applicable refund in accordance with South African law.
17. DELIVERY OF THE WRONG PRODUCT
If you receive a product that is different from the product you ordered, please contact Links & Co.
Depending on the circumstances, Links & Co may arrange:

collection of the incorrect product;

delivery of the correct product;
-
replacement; or
-
refund.
Where the incorrect product was supplied due to an error in the fulfilment process, Links & Co will coordinate the appropriate return and replacement arrangements.
Customers should not return products directly to a supplier or fulfilment partner unless Links & Co has specifically instructed them to do so.
18. CUSTOMER RESPONSIBILITIES
Customers are responsible for:

ensuring someone is available to receive the delivery where required;

responding to reasonable delivery enquiries;

following applicable courier delivery instructions; and

notifying Links & Co promptly if delivery information changes before dispatch.

19. DELIVERY TRACKING
Where tracking is available, Links & Co or the applicable courier may provide tracking information.
Tracking information may show:

order dispatch;

courier collection;
-
transit status;
-
delivery attempts; and
-
final delivery.
Tracking information is provided for convenience and may be subject to updates or delays in the courier's systems.
A tracking status may not always update immediately.
20. WEEKENDS AND PUBLIC HOLIDAYS
Unless otherwise stated, the 15-business-day estimated delivery period excludes weekends and South African public holidays.
Orders placed during weekends or public holidays will generally begin processing on the next applicable business day.
Courier operating schedules may also vary during public holidays and peak periods.
21. PEAK PERIODS
During periods of unusually high demand, including major promotional campaigns, Black Friday, festive periods or other seasonal events, order processing and delivery may take longer than usual.
Links & Co will make reasonable efforts to communicate material delays where they become known.
The applicable estimated delivery period will be communicated to customers as clearly as reasonably possible.
22. INTERNATIONAL DELIVERY
Links & Co currently focuses on deliveries within South Africa.
International delivery is not generally available unless specifically stated on the relevant product page or agreed with the customer.
If international delivery becomes available, additional terms may apply regarding:

international shipping;

customs;
-
import duties;
-
taxes;
-
import requirements;
-
delivery times; and
-
responsibility for additional charges.
23. DELIVERY AND CONSUMER RIGHTS
Links & Co recognises that South African consumer law provides consumers with rights regarding delivery and fulfilment.
The CPA and ECTA contain requirements relating to the supply and delivery of goods purchased through electronic commerce.
Nothing in this Shipping & Delivery Policy is intended to remove, restrict or waive any statutory consumer right.
Where a mandatory consumer right applies, that right will prevail over any conflicting voluntary policy term.
